Working in a construction site is difficult and dangerous at the same time. If a construction employee is not careful enough, he might get into a construction accident. Like many types of accidents, construction accidents often happen because of negligence. Here are some common acts of negligence that cause these accidents:

Faulty wiring – This hazard poses risks to workers being burned or electrocuted. Employees should make sure that wires are kept away from scaffolds, machines, and areas where people pass by.
Poorly-built scaffolds – If a scaffold is not built properly, it might fall, injuring or killing the employees aboard it.
Machine operator negligence – Construction machinery such as cranes and forklifts should be operated only by a skilled and properly trained employee.
Mishandling of dangerous substances – Chemicals and explosives should be handled with care to avoid injuries, intoxication or explosives.

If you are a construction worker and you got injured in a construction accident, you need to make the responsible parties pay. But the question is who the responsible parties are. Here are some of the possible liable parties in a construction accident:

A construction employee – If an employee’s negligence resulted to an accident, he may be held liable for the damages.
The employer or construction administrator – Under vicarious liability, employers will be held responsible for the fault of their employees. If the construction management failed to place a warning sign in a dangerous area, they would also be responsible for any accident that may happen.
A substance or machine manufacturer – If the accident was caused by defective equipment, its manufacturer should be responsible for your losses.

Before you decide who the responsible party is, you should first hire an employment or personal injury attorney for your complaint. Let him conduct an initial investigation first to find out if there were one or more liable parties in the accident. After gathering the necessary documents, then you can file your construction accident liability case against the defendant.

Aside from seeking compensation from the responsible party, you also have the right to obtain worker’s compensation benefits from your employer. And because you were injured during working hours, you will certainly become eligible to receive such benefits.

Construction accidents are unfortunate situations that claim lives and cause severe injury. If you were one of the injured victims of a construction accident, seek legal assistance from a Los Angeles Personal Injury Lawyer for you to obtain the compensation you deserve.

Illinois Personal Injury Lawyers Protect your Rights in a Construction Accident

If someone you love is a construction worker, you know the worries a person goes through every time that loved one walks out the door to go to work. Your worries are not unjustified, as construction site accidents kill and injure hundreds of thousands of construction workers every year. In fact, the construction industry is known to be one of the most dangerous jobs in the United States.

If someone you love has been injured or killed in a construction accident, it is imperative you contact an Illinois personal injury lawyer immediately following the accident. You and your loved one have rights, and it is important that you seek the advice of an Illinois injury lawyer to protect those rights.

The company the construction worker works for will try to make the accident seem like it was his/her and that he/she did something negligent to cause the accident. Never feel intimidated by a construction company. It is the construction company’s job to make sure that the construction site is safe.

What kinds of construction accidents are there?

•    Unsafe Heavy Equipment
•    Unsafe Work Methods
•    Unsafe Site Conditions
•    Improper Safety Equipment
•    Lack of Proper Training
•    Disregard to Safety by the Company
•    Roof Collapses
•    Structural Collapses
•    Cave-Ins
•    Roof falls
•    Crane Accidents
•    Elevator Shaft Falls
•    Floor Collapses
•    Electrocution
•    Unsafe Tools
•    Defective Conveyor Belts
•    Dangerous Hoists

These are only a few instances of where a construction accident could happen. The equipment construction workers use on a daily basis is dangerous in itself. If a person is not trained properly on this heavy equipment, tragedy can result. A forklift and wheel tractor scraper is two kinds of heavy equipment a construction worker will likely use. Not only will improper training cause accidents, but tractors can rollover. Scaffolding is another dangerous part of the construction world. This temporary piece of platform is used to reach places higher up.
If this happens to you or your loved one, it is important that you contact a Peoria injury lawyer right away. The construction company will likely try to put the blame on the construction worker, and this can be prevented if an Illinois injury lawyer is involved from the beginning.

What is a construction company responsible for?

They are responsible for providing a safe work environment. They must be sure they take all precautions to ensure the safety of construction workers. This includes making sure that maintenance has been done on all equipment, tools, and vehicles that the workers use on the site.
The construction company is responsible for making sure that any and all safety standards and regulations are being followed. This includes training employees to report unsafe or harmful conditions on the construction site in an attempt to avoid a construction accident.

Why is it important to talk to an Illinois personal injury lawyer?

An Illinois injury lawyer is going to fight for your rights. A Peoria lawyer will not be intimated by the construction company or its lawyers or insurance company. An Illinois personal injury lawyer is going to make sure you get the money you deserve, as well as the highest quality medical attention available. Contacting a Peoria personal injury lawyer right away will ensure a better outcome for you.

The Best Injury Lawyer offers Illinois Injury Lawyer and Illinois Personal Injury Lawyers to resolve your cases related to Personal Injury.

5 Common Accident At Work Claims

In this article we look at the five most common work accident claims.

1. Wet floors.

Wet floors in any working environment can be particularly hazardous. Spillages can be particularly dangerous in hotels and restaurants due to the amount of rushing around. Often spillages can be left on the floor unattended and waiting staff, not knowing about them, return to the kitchen with their sight blocked by the items they are carrying and slip on the floor. Whilst most slipping injuries do not usually lead to serious injuries, if the waiter or waitress is carrying items, this often prevents them from softening their fall by using their hands meaning that they fall on their elbows or on their hips. This can lead to serious fractures.

Usually the leak could have been cleared away more quickly or a faulty machine repaired more swiftly. It is the failure to repair or clean up the leak that often leads to a successful accident at work claim.

2. Factory Accidents.

Factories by their nature (machinery and many people working long hours) can be dangerous places to work. This section does not deal with the common machinery accidents that feature later as one of the top five, but more to do with the people involved and the materials used in factories.

The most common type of factory accident normally involve workers tripping over discarded packaging. Every employer must ensure that the packaging used is placed in safe containers and not thrown on to the floor.

However, if an employer does not ensure the staff are trained correctly or provide facilities for disposal of packaging, this can lead to it being discarded and workers tripping over it. Once again, as with tripping accidents, quite frequently no serious injury is sustained. However, sometimes fractures to legs and arms lead to serious pain, time away from work and an accident at work claim being made.

3. Warehouse Accidents.

There are many different types of warehouse accidents, but one of the most common forms involves storage facilities. If warehousement are regularly using shelves, stacking and unstacking items, any weaknesses in the shelves will soon lead to them collapsing. In the worst cases this can actually lead to a trapping injury when shelving comes away from the wall and falls on to the warehouse person. These can lead to serious injuries and long term complications.

If the shelving was not correctly positioned in the first place or was not maintained, this can lead to a successful accident at work compensation claim.

4. Forklift Truck Accidents.

These are frequently the cause of accidents. Every forklift truck driver must receive training and the employer must ensure that only trained people use the forklift truck. If they do not supervise sufficiently and untrained handlers use the forklift truck, or even trained handlers use the forklift truck but drop pallets or cause items to fall on to other co-workers, this can lead to a successful claim for compensation.

5. Machinery Accidents.

Although left until last, the injuries sustained during the use of machinery can be extremely severe. If staff are not properly trained, or the machinery is not maintained, or guards are not fitted, workers can suffer severe injuries leading to amputations and even in some cases death. Machinery is by its nature, dangerous and the utmost care must be exercised by workers and by employers.

Summary.

This article explored five most common types of work accident claims, but there are many more. If you have been injured in an accident at work you should seek help from a specialist work accident solicitor.

What are your thoughts about the Monster Jam Accident? (click to read description)?

TACOMA, Wash. (Jan. 18) – Investigators were examining pieces of the drive train from an oversized truck Sunday to learn why parts tore off the truck and struck and killed a 6-year-old boy and injured another spectator at a monster truck show.
Witnesses described the boy, Sebastian Hizey, being struck in the head by a Frisbee-sized chunk of metal that tore off a truck doing doughnuts during the Monster Jam show Friday night in the Tacoma Dome.

Investigators were trying to figure out what went awry after a chunk of metal flew off an oversized truck at a Monster Jam show in Tacoma, Wash., and struck and killed a 6-year-old boy Friday. “You go out for a night of fun, and you lose your son,” Jessie Hizey said. Here, he and Sebastian pose for a photo at the Tacoma Dome minutes before the accident.

Police gathered loose parts of the drive train and the drive train loop, a special monster truck device that is supposed to hold the drive train on the vehicle, Bill Easterling, senior operations director for Feld Motor Sports of Aurora, Ill., told The Associated Press on Sunday.
He said he could give no further details or description of the loose parts, including where they were found. “I’ve never seen the loop or the drive shaft parts come off like this,” said Easterling, whose company is the promoter of the show.
Tacoma police Officer Mark W. Fulghum said no further information on the parts or other aspects of the investigation would be available before Monday at the earliest.
The second spectator struck by debris was taken to a hospital, but authorities haven’t disclosed his name or condition.
Monster truck shows have been a staple at the Tacoma Dome for more than 20 years, featuring vehicles weighing 9,000 pounds or more and equipped with 5-foot tires. Drivers pop wheelies and engage in competition.

Feld has “a stellar safety record” with no prior significant accidents in Tacoma, said Mike Combs, city director of public assembly facilities.
The boy’s father, Jessie Hizey of Puyallup, told The News Tribune of Tacoma, a metal ring weighing 7 to 12 pounds sheared off part his son’s skull. They and other relatives were sitting in grandstands 20 to 25 feet above the arena floor.
Jessie Hizey said the red and silver truck, Natural High, at first failed to start and was hauled away by forklift. It returned to the show, and the metal ring flew from under the truck as it was spinning in tight circles in the mud.
“You go out for a night of fun, and you lose your son,” Hizey said in a whisper, his face twisted in grief.
Easterly told the Seattle Post-Intelligencer the driver of Natural High was “absolutely devastated.”

Forklift Accident. Serious answers please?

I work at a hardware store in the ‘back yard’ where all the lumber is kept. Today, a customer asked for a pallet of wood pellets, so I went and fetched some and brought them to him with the forklift.

I failed to realize a customer had driven his truck behind me as I was picking up the wood pellets (very close behind me) and as I reversed, I backed up into his front bumper and created a decently-sized dent in the chrome.

I was given no training on the forklift, and had yet to write the required test, but had been given permission to use the forklift by management.

I’m just wondering if I’m going to have to pay for this accident…or if it would be the company’s responsibility to pay…and I’ve been quite worried about it.

I feel horrible, and I’ll continue to feel horrible even if I don’t have to pay, because this has been a great job for me and all my supervisors are great and very friendly, and I feel bad about this accident happening. Thanks very much for your answers!
Oklatom, you make it sound like I wouldn’t have realized that already.

Yes, I fully intentionally didn’t look in my mirror to check for vehicles because I intended on smashing into someone’s bumper, for sure.
xxx000au
I’m perfectly aware that I was at fault by not looking in my rearview. I stated that as I added in the additional details, which, may I add, was not a personal attack, rather was a way of saying that pointing out the obvious isn’t what I was looking for. The fact that I ran BACKWARDS into something BEHIND ME I imagine would give people the hint that I know that what I did was wrong. I wasn’t asking for opinions on my driving. Read the question again if you’re unsure. I asked who’s LIABLE, who will be forced to PAY, and gave some background information. NOWHERE in that question did I mention ANYTHING about critiquing my driving, or anything of that sort.

So before you feel the need to deal out another round of ‘look where you were going’, please, read the question, and answer the question, and leave it at that, because that’s all that was asked for.
Thanks.
Ironball,
My work area is open to all customers and they are able to walk around at their free will to browse products such as lumber and anything that we have inside.
Children aren’t permitted inside this area.
